It’s important to note that while we can manage delays within our control, we may not have control over delays caused by government processes or deficiencies in submitted documents. We kindly request your patience and understanding as our team endeavours to complete your service to the best of our ability.

 Refund Policy

If the ongoing engagement doesn’t meet your expectations, you may request a refund of the professional fee within 3 days of payment. Please note that refunds will be issued in the form of service credits, not as monetary reimbursement. These service credits are redeemable for any future services. 

Earned Fee & Cancellation Fee Deduction

Prior to issuing any refund, we maintain the right to exert our best effort to fulfil the service. If the service provided does not meet your satisfaction and a cancellation is requested, a cancellation fee of 20%, in addition to any earned fees and government-related payments, will be applied. Therefore, all refunds will incur a minimum cancellation fee of 20%. Additionally, should Y M K & Company have invested time, resources, or incurred additional expenses to complete the service, these costs will be deducted at the company’s discretion, and the remaining balance will be refunded.

Change of Service

If you wish to exchange the service you initially ordered for a different one, you may request this change within 3 days of purchase. Please note that the company reserves the right to approve or decline the change of service. The original service’s purchase price will be refunded, deducting any earned fees and payments made to government entities (e.g., filing fees or taxes) or other third parties. The new service will then be initiated.

Request Refund

To request a refund, please send an email to complaints@ymkca.com with transaction details to initiate the refund process. Refunds are typically processed within 3-5 weeks from the date of request, provided all relevant information is included. 

Penalty or Tax Payment

Y M K & Company and its employees serve as corporate service providers. While our responsibility lies in preparing the requisite filings, ensuring accuracy and correctness remains the client’s responsibility. Therefore, Y M K & Company will not cover any penalties or taxes on behalf of its clients. Additionally, Y M K & Company bears no responsibility or liability for any additional costs incurred by the client related to services beyond the defined scope.

Factors Outside our Control

We cannot ensure a guaranteed outcome for your specific procedure. For example, the government might reject a trademark application due to legal reasons that are beyond the scope of Y M K & Company’s service. Occasionally, government backlogs or issues with government platforms (e.g., MCA website, Income Tax website, FSSAI website) can cause substantial delays before your process is finalized. Likewise, Y M K & Company cannot assure specific outcomes for services provided by our Associates, who are not employed directly by our company. These issues are beyond our control and are not covered by our guarantee or eligible for a refund. Therefore, delays in government processing cannot warrant a refund.

Force Majeure

Y M K & Company shall not be deemed in violation of its refund policy or in default under any terms of service, and shall not be held accountable to the Client for any cessation, interruption, or delay in fulfilling its obligations due to circumstances including but not limited to earthquake, flood, fire, storm, lightning, drought, landslide, hurricane, cyclone, typhoon, tornado, natural disaster, act of God or public enemy, epidemic, famine or plague, action of a court or public authority, change in law, explosion, war, terrorism, armed conflict, labour strike, lockout, boycott, or any similar event beyond our reasonable control, whether anticipated or unforeseen (each event being a “Force Majeure Event”).
